Terms of Use
These Terms of Service ("Terms") govern the conditions of use for the services provided by Hellolive Incorporation ("Hellolive") to users (referred to as "User" or "Users," depending on the context). The services provided by Hellolive, collectively referred to as "Services," are defined as follows.
1.Definitions
The following terms used in these Terms have the meanings outlined below:
Services: Refers to all related services provided by the company, including member content usage and all related services.
Member: A person who agrees to the policies of the Hellolive service and these Terms, creates an account, and can continuously use the services provided by the company.
Non-member: A person who uses the services provided by the company without creating an account.
User: Refers to both Members and Non-members who can use the services provided by the company.
Content: Refers to data or information expressed in signs, texts, sounds, images, or videos used in the information and communication networks as defined in Article 2, Paragraph 1, Subparagraph 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection.
Paid Products: Refers to the services or products provided by the company that can be accessed only by paying a certain amount in the service. These include rights to view specific content, time-based products that can be used only during the period to use the 'Content,' and official products related to artists.
Cube: Refers to the currency provided by the company that can be used to access various paid services, either directly charged by the member or received as rewards from company events.
2.Acceptance of Terms
2.1. All Users must use the Services in accordance with these Terms. Users cannot use the Services unless they agree to these Terms.
2.2. Minors must obtain prior consent from a parent or legal guardian to use the Services. If using the Services on behalf of a business entity, the entity must also agree to these Terms before using the Services.
2.3. If there are separate terms applicable to specific Services, Users must comply with these separate terms in addition to these Terms.
3.Account
3.1. Users may need to register certain information and create an account to use the Services. Users must register accurate, truthful, and complete information and update it to keep it current.
3.2. When registering authentication information for the Services, Users are responsible for managing it to prevent illegal use. Hellolive may regard all activities conducted under the registered authentication information as activities conducted by the registered User.
3.3. Registered Users may delete their accounts and cancel their services at any time.
3.4. Hellolive reserves the right to delete accounts that have been inactive for over a year without prior notice.
3.5. Each account is exclusive to the User and may not be transferred, leased, or disposed of to any third party, nor can it be inherited or succeeded by any third party.
4.Personal Information
4.1.Hellolive prioritizes the protection of Users' personal information.
4.2. Hellolive will appropriately handle Users' personal information in accordance with the Hellolive Privacy Policy.
4.3. Hellolive promises to make every effort to securely manage all collected information.
5.Provision of the Service
5.1. Users are responsible for preparing the necessary devices, operating systems, communication methods, and electricity at their own expense to use the Services.
5.2. Hellolive reserves the right to restrict access to all or part of the Services based on conditions deemed necessary.
5.3.Hellolive reserves the right to modify all or part of the Services as deemed necessary without prior notice.
5.4. Hellolive may suspend all or part of the Services without prior notice in the following cases: (1) For system maintenance or repairs; (2) In cases of force majeure such as fires, power outages, natural disasters, wars, riots, or labor disputes; (3) If there is a system malfunction or system overload; (4) If it is deemed necessary for the safety of Users or third parties; or (5) In any other cases where Hellolive reasonably deems it necessary.
6.No Emergency Call Functions
The Services cannot be relied upon for emergency calls to law enforcement, maritime safety authorities, fire departments, or other emergency services.
7.Advertisements
Hellolive reserves the right to post advertisements for Amond or third parties within the Services.
8.Third-Party Services
The Services may include services or content provided by third parties other than Amond. These third parties are solely responsible for such services or content. Users may also be subject to separate terms or conditions for the services and content provided by these third parties.
9.Content
9.1. "Services" provides the following services to Users:
Content streaming services
Time-limited content replay services
1:1 video call services with artists
Artist-related product services
Services that provide points for viewing advertisements
Virtual currency/point deposit and withdrawal services
The form and functions of the Services provided may change or be discontinued as necessary, and the company does not individually notify members of such changes.
In the case of free services provided, no separate compensation is made to members if the services are changed or discontinued.
9.2. The company provides notices regarding the characteristics, procedures, and methods of each service through the service screen, and members must understand these notices to use the services.
9.3. The company may notify or inform members of changes to these Terms or service contents through the member's registered email address and service homepage. The company is not responsible for any damages caused by members not reviewing these notifications due to email address errors or email service disruptions.
9.4. Content purchased by members may be limited in terms of accessible devices, streaming periods, and frequency. For physical products, the "Service" informs members about the quantity and delivery information.
9.5. The "Service" operates 24/7 year-round unless there are special issues in the company's work or technology. However, the company may set specific dates or times for service maintenance.
9.6. The company may divide the "Service" into different segments and set separate availability times for each segment, which will be announced in advance.
9.7. The scope of use rights for purchased content is limited to the personal and non-commercial use of the purchasing member. Public screenings are not included within this scope, even if for non-profit/non-commercial purposes, and the company is not liable for any damages incurred by the member due to copyright infringement.
10.Restrictions
Hellolive prohibits Users from engaging in the following actions when using the Services:
10.1 Violating laws, regulations, court rulings, resolutions, or orders, or legally binding administrative actions;
10.2 Engaging in activities that may violate public order, morals, or customs.
10.3 Infringing upon copyrights, trademark rights, patent rights, honor rights, privacy rights, and all other rights granted by contracts with Amond and/or third parties.
10.4 Using the Services for business, marketing, advertising, solicitation, or other commercial purposes (except with Amond's approval); using the Services for sexual activity or obscene behavior; using the Services for sexual encounters or contact with unspecified third parties; using the Services for harassment or defamation attacks on other users; or using the Services for purposes other than the intended purpose.
10.5 Engaging in activities that collaborate with or benefit anti-social groups.
10.6 Interfering with the server and/or network system of the Services; using bots, cheat tools, or other technical means to fraudulently manipulate the Services; intentionally exploiting flaws in the Services; repeatedly asking unnecessary questions or making excessive inquiries and/or unreasonable claims, or engaging in any other activities that interfere with the operation of Amond's services or other users' use of the Services.
10.7 Deciphering the source code of the Services through reverse engineering, disassembly, or other improper methods for fraudulent purposes.
11.User Responsibility
11.1 Users must use the Services at their own risk and bear responsibility for all activities and consequences arising from their use of the Services.
11.2 Hellolive may suspend or terminate all or part of the Services without prior notice and may suspend or delete the user's account and cancel the service contract (including but not limited to contracts entered into under these Terms) with the User or take other measures deemed reasonably necessary if the following conditions or a potential for such conditions exist: (1) The User violates applicable laws and regulations; (2) The User is a member of or related to an anti-social group; (3) The User spreads false information or undermines Amond's credibility through fraudulent means or coercion; (4) The User is subject to claims for seizure, temporary seizure, or auction, or bankruptcy, civil rehabilitation, or similar procedures have been initiated; or if Amond reasonably determines that there is uncertainty in the trust relationship with the User; (5) If there are other reasons where the trust relationship with the User has been lost, or if Amond reasonably determines it is inappropriate to provide services to the User.
12.Service Restrictions
12.1 Hellolive may immediately restrict the use of services other than the login service in the following cases: (1) In the event of hacking/fraud incidents; (2) Upon a withdrawal request; (3) Excessive accumulation of monthly points; (4) When a state agency requests restrictions on services in accordance with relevant laws and regulations; (5) Reasonable suspicion of unfair use; (6) When the password entered at login is incorrect five consecutive times. However, in certain cases, the company may provide an opportunity for explanation to the member, and the restrictions may be lifted if a reasonable explanation is provided by the member.
12.2 Hellolive may refuse approval or cancel approval later without prior notice if a member's purchase application falls under any of the following items: (1) The purchase application is made using another person's name or alias; (2) False information is provided or required information is not provided; (3) A minor under the age of 19 applies without the consent of a legal representative; (4) Payment for the purchase is not actually made or is unlikely to be made; (5) There are no facilities related to the service, or there are technical or operational problems; (6) The purchase is considered to be for fraudulent or abusive purposes, such as continuous payments using similar IDs, payments from suspicious IPs, etc.; (7) The member's purchase application poses a risk of harm to the 'Service' or the interests of third parties. 12.3 Users shall not duplicate, distribute, rent, transfer, sell, or otherwise provide the usage rights of purchased content to third parties (including providing passwords or devices that allow access to the content), nor attempt to bypass, remove, disable, or damage encryption, rights notices, or copy protection technologies that protect the content. If decompilation, modification, copying, reverse engineering, tampering, or disassembly of computer files containing the content is discovered, the use of the 'Service' may be immediately restricted.
13.NO WARRANTY
Hellolive makes no explicit or implicit warranty regarding the absence of defects (including but not limited to defects related to security, errors, or bugs, infringement of rights, etc.), safety, reliability, accuracy, completeness, effectiveness, or suitability for specific purposes concerning the service. Amond is not obligated to provide the service to the user after removing such defects.
14.Relationship Between These Terms and Laws and Regulations
In the event that any provision of these Terms violates the laws and regulations applicable to the contract between the user and Amond concerning the service (including but not limited to the Korean Consumer Contract Act), such provisions shall not apply to the contract with the user to the extent of such violation. However, the remaining provisions shall not be affected.
15.Notices and Communication
15.1 Hellolive may notify users of the service by any means deemed appropriate (such as posting in an appropriate location within the service or on Hellolive's website).
15.2 When users notify Hellolive of matters concerning the service, they must use the customer inquiry form provided within the service or on Hellolive's website, or other means designated by Hellolive.
16.Governing Law and Jurisdiction
If Hellolive provides a Korean version of these Terms (hereinafter referred to as the "Korean Version"), the Korean Version shall govern the relationship between the user and Amond. In the event of a conflict between the Korean Version and its translation, the provisions of the Korean Version shall prevail. These Terms shall be governed by Korean law, and disputes between the user and Amond concerning the service shall be resolved by the Seoul Central District Court as the court of first instance with exclusive jurisdiction.
